Terms and Conditions of the Online Store

These Terms and Conditions of the Online Store (the “Terms”) govern the sale of digital content and electronic gift vouchers through the online store available at alenagurenchuk.com, including the subdomains cs.alenagurenchuk.com and ru.alenagurenchuk.com (the “Store”).

These Terms are prepared in accordance with Act No. 89/2012 Coll., the Czech Civil Code, Act No. 634/1992 Coll., on Consumer Protection, and other applicable Czech and EU consumer protection legislation.

These Terms apply only to purchases made through the Store. Photography services themselves are governed by separate Terms and Conditions of Photography Services agreed directly with the client.

1. Seller

The seller and operator of the Store is:

Alena Surova, self-employed person / OSVČ, doing business in photography and also known publicly as Alena Gurenchuk.

The Seller is not a registered VAT payer.

2. Definitions

For the purposes of these Terms:

  • “Customer” means the person placing an order through the Store. The Customer may be a Consumer or an Entrepreneur.
  • “Consumer” means a natural person who, when concluding and performing the contract, is not acting in the course of their business or profession, within the meaning of § 419 of the Czech Civil Code.
  • “Entrepreneur” means any Customer who does not qualify as a Consumer.
  • “Products” means the digital content and electronic gift vouchers offered in the Store.
  • “Digital Content” means PDF checklists and similar downloadable or electronically delivered materials offered in the Store.
  • “eGift Card” means an electronic gift voucher delivered as a PDF document, representing a monetary value that may be redeemed for photography services provided by the Seller.

3. Products offered in the Store

The Store currently offers the following Products:

3.1 Digital Content — PDF checklists

The Store may offer PDF checklists and similar digital materials, including but not limited to:

  • Checklist №1 — Preparing for a photo shoot: a general PDF checklist for preparing for a photoshoot
  • Checklist №3 — Preparing for a family photo shoot: a PDF checklist focused on preparing for a family photoshoot

The Seller reserves the right to add, modify, replace, temporarily hide, or withdraw any Digital Content from the Store at any time.

3.2 eGift Cards

The Store may offer electronic gift cards delivered as PDF vouchers.

The Customer may choose the purchase price, starting from 21.

An eGift Card represents a monetary value that may be used for photography services provided by the Seller.

The eGift Card is valid for 12 months from the date of purchase, unless a different validity period is expressly stated on the voucher.

The minimum value of an eGift Card is shown on the relevant Product page and may differ depending on the selected currency.

3.3 Product descriptions

Detailed descriptions of each Product are provided on the relevant Product page in the Store.

The Product description forms part of the pre-contractual information provided to the Customer before purchase.

4. Prices and currencies

All prices in the Store are shown including all applicable taxes and charges.

The Seller is not a registered VAT payer; therefore, VAT is not charged.

Prices may be displayed in CZK, EUR, or USD, depending on the Customer’s choice and the technical settings of the Store.

The currency selected at the time of payment determines the amount actually charged.

The price displayed at the time of placing the order is binding for both parties.

If currency conversion is applied by the Customer’s bank, card issuer, PayPal, SumUp, or another payment provider, any exchange rate differences or conversion fees are borne by the Customer.

5. Order process and conclusion of the contract

5.1 Placing an order

The Customer places an order through the relevant Product page in the Store by:

  1. selecting the Product,
  2. entering the desired amount, where applicable,
  3. providing the required order details, including email address,
  4. selecting the payment method,
  5. confirming agreement with these Terms and the Privacy Policy,
  6. in the case of Digital Content, confirming express consent to immediate delivery and acknowledging the loss of the right of withdrawal,
  7. submitting the order and completing payment through the selected payment provider.

5.2 Conclusion of the contract

The contract between the Customer and the Seller is concluded at the moment when the Customer successfully completes the payment through the chosen payment provider.

The Customer’s payment constitutes acceptance of the Seller’s offer presented in the Store.

The Seller will confirm receipt of the order by email without undue delay after payment.

5.3 Language of the contract

The contract may be concluded in English, Czech, or Russian, depending on the language version of the Store used by the Customer.

In case of inconsistency between language versions of these Terms:

  • the Czech version prevails for Customers resident in the Czech Republic,
  • the English version prevails for Customers resident outside the Czech Republic, unless mandatory consumer protection rules provide otherwise.

5.4 Archiving the contract

The Seller archives basic information about the order, including the Customer’s email address, Product, amount, date of purchase, and invoice information, for the period required by applicable law.

The Customer may request a copy of the order information by contacting the Seller by email.

6. Payment

6.1 Payment methods

The Customer may pay for Products by the payment methods currently available in the Store, including:

  • payment card via SumUp,
  • PayPal.

The Seller may add, remove, or temporarily disable payment methods depending on technical availability.

6.2 Payment processing

Payments are processed directly by the chosen payment provider on its own technical infrastructure.

The Seller does not store full payment card numbers or full payment card details.

6.3 Currency conversion

If the Customer pays in a currency different from the currency of their payment card, bank account, or PayPal account, currency conversion may be applied by the payment provider or the Customer’s bank.

Any conversion fees, exchange rate differences, or bank charges are not part of the Product price and are borne by the Customer.

6.4 Invoice

After receipt of payment, the Seller will issue an invoice and send it to the email address provided by the Customer.

The invoice serves as proof of purchase.

7. Delivery of Products

7.1 Delivery of Digital Content

Digital Content is delivered electronically as a PDF file or as access to a PDF file.

After payment is received, the Seller will deliver the Digital Content to the email address provided by the Customer within 24 hours at the latest.

In practice, delivery usually takes place sooner.

If the Customer does not receive the PDF within 24 hours, the Customer should:

  1. check the spam, junk, or promotions folder of their email inbox,
  2. make sure the email address provided in the order was correct,
  3. contact the Seller at [email protected].

The Seller will resolve delivery issues without undue delay.

7.2 Delivery of eGift Cards

The eGift Card is delivered electronically as a PDF voucher to the email address provided in the order.

If no specific delivery date is selected, the eGift Card will be delivered within 24 hours after payment.

If the Customer chooses the option to send the eGift Card on a specific date, the Seller will send the eGift Card on the selected delivery date.

If the Customer requests that the eGift Card be sent directly to the recipient, the eGift Card will be delivered to the recipient’s email address provided in the order.

The Customer is responsible for providing the correct email address.

7.3 Electronic delivery only

All Products in the Store are delivered exclusively in electronic form.

No physical delivery is available.

7.4 Risk of incorrect email address

The Customer is responsible for entering the correct email address when placing the order.

If the Customer provides an incorrect email address, the Seller will assist with re-delivery after being notified, provided that the Product has not been unlawfully used by a third party.

8. Right of withdrawal — Digital Content

8.1 Express consent and loss of the right of withdrawal

Digital Content is not delivered on a tangible medium.

Under § 1837 of the Czech Civil Code, the Consumer does not have the right to withdraw from a contract for the supply of digital content not delivered on a tangible medium if performance has begun with the Consumer’s prior express consent and the Consumer has acknowledged that this results in the loss of the right of withdrawal.

When ordering Digital Content, the Customer is required to give express consent by ticking the relevant checkbox during checkout.

By ticking this checkbox, the Customer:

  • expressly requests that the Digital Content be delivered before the expiry of the 14-day withdrawal period,
  • acknowledges that once the Digital Content is delivered, the right of withdrawal is lost.

Without this express consent, the order for Digital Content cannot be completed.

8.2 Withdrawal before delivery

If the Customer changes their mind after payment but before the Digital Content has been delivered, the Customer may notify the Seller by email at [email protected].

In such a case, the Seller will refund the payment in full and will not deliver the Digital Content.

Once the Digital Content has been delivered to the Customer’s email address, the right of withdrawal no longer applies.

9. Right of withdrawal — eGift Cards

9.1 General rule

For eGift Cards purchased by Consumers, the standard 14-day right of withdrawal applies, provided that the eGift Card has not yet been redeemed.

The Consumer may withdraw from the contract within 14 days of receiving the eGift Card.

9.2 How to withdraw

The Consumer may withdraw from the contract by sending an unambiguous statement to:

The Consumer may use the model withdrawal form included as Annex 1 to these Terms, but using the form is not mandatory.

Withdrawal does not require any reason.

9.3 Effects of withdrawal

If the Consumer validly withdraws from the contract:

  • the Seller will refund the full amount paid,
  • the refund will be made using the same payment method used for the order, unless otherwise agreed,
  • the refund will be made within 14 days of receiving the withdrawal notice,
  • the eGift Card will be cancelled and can no longer be used.

9.4 Loss of the right of withdrawal

The right of withdrawal is lost once the eGift Card has been redeemed for a photography service.

An eGift Card is considered redeemed when it is used to book or pay for a photography service with the Seller.

9.5 Validity and use of the eGift Card

The eGift Card is valid for 12 months from the date of purchase, unless otherwise stated on the voucher.

The eGift Card represents a monetary value, not a reservation of a specific photography package, date, or price.

Photography services are provided according to the Seller’s price list valid at the time of booking, unless otherwise agreed in writing.

Redeeming an eGift Card is subject to the Seller’s availability, booking process, photography service terms, and cancellation conditions.

The eGift Card is not exchangeable for cash.

The eGift Card may be transferred to another person. The original purchaser does not have to be the person redeeming the voucher.

If the price of the photography service exceeds the value of the eGift Card, the difference is paid by the person redeeming the eGift Card.

If the price of the photography service is lower than the value of the eGift Card, the remaining balance may be used for another photography service within the original validity period. The remaining balance is not paid out in cash.

If the eGift Card is not redeemed within the validity period, it expires and cannot be exchanged for cash or extended, except where required by mandatory consumer protection law.

10. Defects and complaints

10.1 Liability for defects

The Seller is liable for defects of the Products in accordance with applicable provisions of the Czech Civil Code.

For Digital Content, the Seller is responsible that:

  • the PDF file is delivered in a readable format,
  • the content corresponds to the description on the Product page,
  • the file is not intentionally corrupted or unusable.

For eGift Cards, the Seller is responsible that:

  • the voucher contains the correct value,
  • the voucher contains the correct validity period,
  • the voucher can be redeemed for photography services according to these Terms and the applicable photography service terms.

10.2 What is not considered a defect

The following is not considered a defect:

  • the Customer no longer wants to use the Product after delivery,
  • the Customer expected different content although the Product corresponded to its description,
  • the Customer provided an incorrect email address,
  • the Customer failed to download, save, or use the Product in time despite successful delivery,
  • the eGift Card expired because it was not redeemed within the validity period.

This does not affect the Consumer’s statutory rights.

10.3 How to file a complaint

The Customer may file a complaint by sending an email to: [email protected].

The complaint should include:

  • order number, if available,
  • email address used for the order,
  • date of purchase,
  • description of the defect,
  • preferred remedy.

10.4 Resolution of complaints

The Seller will confirm receipt of the complaint without undue delay.

Consumer complaints will be settled, including notification of the result, within 30 days of receipt of the complaint, unless a longer period is agreed with the Consumer.

Available remedies may include, depending on the nature of the defect:

  • re-sending the PDF,
  • providing a corrected file,
  • issuing a corrected eGift Card,
  • refunding the price paid, where the defect cannot be resolved otherwise.

11. Out-of-court dispute resolution

In accordance with Act No. 634/1992 Coll., on Consumer Protection, Consumers have the right to use out-of-court dispute resolution.

The competent body for out-of-court resolution of consumer disputes arising from purchase contracts concluded under these Terms is:

Consumers may use this option free of charge and on a voluntary basis.

12. Governing law and jurisdiction

These Terms and any contract concluded under them are governed by Czech law, in particular by the Czech Civil Code and the Consumer Protection Act.

For Consumers resident in another EU Member State, mandatory consumer protection rules of the Consumer’s country of residence apply where they provide a higher level of protection than Czech law.

Disputes shall be resolved primarily by amicable negotiation.

If no amicable solution is reached, disputes shall be resolved by the competent courts of the Czech Republic, without prejudice to mandatory consumer jurisdiction rules applicable to Consumers under EU law.

13. Intellectual property

All Digital Content offered in the Store, including PDF checklists, texts, layouts, designs, images, and related materials, is protected by copyright.

By purchasing Digital Content, the Customer obtains a non-exclusive, non-transferable license to use the content for personal, non-commercial purposes only.

The Customer is entitled to:

  • download and save the Digital Content for personal use,
  • print the Digital Content for personal use,
  • share the Digital Content within their immediate family or partnership where the photoshoot is being prepared.

The Customer is not entitled to:

  • resell the Digital Content,
  • distribute it publicly,
  • upload it to social media, file-sharing platforms, or third-party websites,
  • modify it for commercial use,
  • remove copyright notices, branding, or author identification,
  • use it as their own product or template for resale.

The eGift Card may be transferred to another person for the purpose of redeeming the voucher for photography services from the Seller.

No other license is granted.

14. Personal data

The processing of personal data in connection with orders placed through the Store is described in the Seller’s Privacy Policy, available at:

The Customer is required to provide accurate personal data necessary for processing the order, issuing an invoice, delivering the Product, and handling possible complaints.

15. Changes to these Terms

The Seller may update these Terms from time to time to reflect changes in the Store, Products, applicable law, payment methods, delivery process, or business practice.

The version of the Terms in force at the time of placing the order applies to that specific order.

The current version of the Terms is always available on this page, with the date of the last update shown at the top.

16. Final provisions

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions remain in full force and effect.

Invalid or unenforceable provisions shall be replaced by valid provisions that correspond as closely as possible to the original purpose.

These Terms enter into force on the date shown at the top of the document.


Annex 1 — Model Withdrawal Form

Use this form only if you wish to withdraw from a contract within the conditions described in Section 9.

This form applies to eGift Cards only. For Digital Content, the right of withdrawal is lost once the PDF has been delivered with the Customer’s prior express consent, as described in Section 8.
